Federal Classification: Schedule II Controlled Substance

Methamphetamine Legal Status

Under federal law, methamphetamine is classified as a Schedule II controlled substance. While pharmaceutical methamphetamine (Desoxyn) exists for extremely limited medical use, illicit meth is widely manufactured and distributed illegally.

New York State Methamphetamine Penalties

Possession Charges by Amount

Misdemeanor

Criminal Possession of a Controlled Substance (7th Degree)

Amount: Less than 500 mg of methamphetamine

Classification: Class A Misdemeanor

Maximum Penalty: Up to 1 year in jail

First-time offenders may be eligible for probation or treatment alternatives

Felony

Criminal Possession of a Controlled Substance (5th Degree)

Amount: 500 mg or more of methamphetamine

Classification: Class D Felony

Maximum Penalty: 2.5 to 7 years in prison

Felony

Criminal Possession of a Controlled Substance (3rd Degree)

Amount: 1/8 ounce (approximately 3.5 grams) or more

Classification: Class B Felony

Maximum Penalty: 8 to 25 years in prison

Felony

Criminal Possession of a Controlled Substance (1st Degree)

Amount: 8 ounces or more

Classification: Class A-I Felony

Maximum Penalty: 15 years to life in prison

Enhanced Penalties for Methamphetamine Manufacturing

Manufacturing methamphetamine carries significantly harsher penalties than simple possession. New York and federal law treat meth labs as serious threats to public safety.

Manufacturing Charges Include:

  • • Unlawful manufacture of methamphetamine
  • • Criminal possession of precursor chemicals
  • • Maintaining a drug premises
  • • Endangering the welfare of a child (if children present)
  • • Environmental hazard violations

Penalties:

  • State charges: Class A-I Felony - 15 years to life
  • Federal charges: 10 years to life with mandatory minimums
  • Additional charges: Chemical disposal violations, property seizure
  • If children present: Enhanced penalties and child endangerment charges
