Zero Tolerance Law for Drivers Under 21

New York's Zero Tolerance Policy

New York has a strict Zero Tolerance Law for drivers under age 21. Any detectable alcohol (BAC of 0.02% or higher) is a violation, significantly lower than the 0.08% limit for adults.

Violation

BAC 0.02% - 0.049%

Charge: Zero Tolerance Violation

Penalties:

  • • $125 civil penalty
  • • 6-month license suspension
  • • $100 license re-application fee
  • • Completion of Drinking Driver Program may be required

Second Offense: 1-year license revocation OR revocation until age 21 (whichever is longer)

Misdemeanor

BAC 0.05% - 0.079%

Charge: DWAI (Driving While Ability Impaired)

Penalties:

  • • Up to $500 fine
  • • Up to 15 days in jail
  • • 1-year license revocation
  • • Mandatory Drinking Driver Program
Misdemeanor

BAC 0.08% or Higher

Charge: DWI (Driving While Intoxicated)

Penalties: Full adult DWI penalties apply (see below)

Underage drivers face the same DWI penalties as adults, PLUS additional underage-specific consequences

Additional Consequences for Underage Drivers:

  • • Criminal record affecting college admissions and financial aid
  • • Significantly higher insurance rates (or policy cancellation)
  • • Full license suspension period must be served (even if Drinking Driver Program completed)
  • • Potential loss of employment requiring driving

Adult DWI/DWAI Penalties (Age 21+)

DWI and DWAI Charges

Traffic Infraction

DWAI (Driving While Ability Impaired)

BAC: 0.05% - 0.07%

First Offense:

  • • Up to $500 fine
  • • Up to 15 days in jail
  • • 90-day license suspension

Second Offense (within 5 years):

  • • $500-$750 fine
  • • Up to 30 days in jail
  • • 6-month license revocation
Misdemeanor

DWI (Driving While Intoxicated)

BAC: 0.08% or higher

First Offense:

  • • Up to $1,000 fine
  • • Up to 1 year in jail
  • • 6-month minimum license revocation
  • • Mandatory Ignition Interlock Device installation
  • • $250 annual fee (Driver Responsibility Assessment) for 3 years

Second Offense (within 10 years):

  • • Becomes Class E Felony
  • • Up to $5,000 fine
  • • Up to 4 years in prison
  • • 1-year minimum license revocation
  • • Permanent criminal record
Misdemeanor/Felony

Aggravated DWI (A-DWI)

BAC: 0.18% or higher (more than 2x legal limit)

First Offense:

  • • Up to $2,500 fine
  • • Up to 1 year in jail
  • • 1-year minimum license revocation
  • • Mandatory Ignition Interlock Device

Subsequent Offense (within 10 years):

  • • Class D Felony
  • • Up to $10,000 fine
  • • Up to 7 years in prison
  • • 18-month minimum license revocation

Chemical Test Refusal

Under New York's Implied Consent Law, refusing a breathalyzer or blood test results in automatic penalties, in addition to any DWI charges:

  • First Refusal: Automatic 1-year license revocation + $500 civil penalty
  • Second Refusal (within 5 years): Automatic 18-month revocation + $750 civil penalty
  • Refusal can be used as evidence in criminal prosecution
  • Separate DMV hearing required - even if criminal charges are dismissed
