Federal Classification: Schedule II Controlled Substance

What is a Schedule II Drug?

Under the federal Controlled Substances Act (DEA) , cocaine is classified as a Schedule II controlled substance, meaning:

High Potential for Abuse

Schedule II drugs have a high potential for severe psychological or physical dependence

Limited Accepted Medical Use

While cocaine has limited medical use (local anesthetic), it's tightly regulated

New York State Cocaine Possession Penalties

Possession Charges by Amount

Misdemeanor

Criminal Possession of a Controlled Substance (7th Degree)

Amount: Less than 500 mg of cocaine

Classification: Class A Misdemeanor

Maximum Penalty: Up to 1 year in jail

Note for First-Time Offenders: Probation may be an alternative to jail time. Treatment programs may be available as part of sentencing.

Felony

Criminal Possession of a Controlled Substance (5th Degree)

Amount: 500 mg or more of cocaine

Classification: Class D Felony

Maximum Penalty: 2.5 to 7 years in prison

Crossing the 500mg threshold significantly increases criminal exposure and potential sentences.

Felony

Criminal Possession of a Controlled Substance (3rd Degree)

Amount: 2 or more ounces of cocaine

Classification: Class C Felony

Maximum Penalty: 5.5 to 15 years in prison

Larger amounts may trigger additional charges related to intent to distribute or sell.
